Trio jailed for nightclub violence

Three men cleared of killing the father of England rugby player Ben Cohen after a fight at a nightclub have been jailed for violent disorder.

Colin Kerr, 32, of Rothersthorpe, Northamptonshire, received a three-year sentence at Birmingham Crown Court. His brother, 33-year-old Gavin, from Far Cotton, Northampton, was jailed for two-and-a-half years. A third man, Robert Evans, 32, from Thorn Hill, Northampton, received the same sentence.

The men were convicted of unlawful violence at the Eternity nightclub in October 2000. The club was owned by Peter Cohen, 58, the father of England rugby international Ben Cohen. Mr Cohen tried to eject the men and a fight started. He was taken to hospital where he died a month later after suffering a blood clot in his brain.

The three men had been acquitted of manslaughter. But the court heard how Mr Cohen was bitten on the face as he lay on the floor of the nightclub, being punched and kicked by three men. Later, when Mr Cohen appeared to lose consciousness, an ambulance was called and he was taken to hospital. He died from deep vein thrombosis caused by immobility a month later.

Giving evidence, a pathologist called by the defence said Mr Cohen's death could have been caused either by taking ecstasy, traces of which were found in his system, or by a history of migraines or the onset of heart disease.
